Section 18 of the Federal
Insecticide, Fungicide and Rodenticide Act (FIFRA) gives
the US Environmental Protection Agency (EPA) the authority
to issue a specific exemption for a pesticide from certain
registration requirements to control a pest problem under
emergency conditions. An emergency means an urgent,
non-routine situation that may be remedied through the use
of a pesticide(s) and shall be deemed to exist when:
- No effective, registered pesticides are available
that have labeled uses for control of the pest.
- No economically feasible alternative practices
which provide adequate control are available.
- The situation involves the introduction or
dissemination of a pest new to or not previously known
to be widely prevalent or distributed in the state or
specific area.
- It must be substantiated that this (new) pest or
problem will cause a significant economic loss.
The term “significant economic loss”
means a substantial reduction either in normally expected
profitability for productive activities or in the value of
public or private assets for the area affected by the
emergency
Section 24(c),
Special Local Need (SLN) Minnesota Department of
Agriculture (MDA) has the authority under Section 24(c) of
FIFRA to register an additional use of a federally
registered pesticide on a food/feed crop for which a
tolerance has been established (or on a non-food/non-feed
crop or site) for use in a special local need situation. A
special local need could include: new application method
or timing, different rate, new pest, less hazardous
formulation, prevention of pesticide resistance or
application to a different soil type. The product
registrant usually submits the request for SLN’s.
SLN registration applications require:
- A description of the special local need.
- Efficacy and or residue data where needed.
- Letter of support from university personnel,
commodity group or other qualified knowledgeable
expert.
- U.S.- EPA application form for “Notification of
State Registration”
- A draft SLN label.
- An application fee of $150.
In Minnesota, SLN registrations are not given an
expiration date but generally are valid until either the
manufacturer, the MDA or the EPA cancels the registration.
